TERMS AND CONDITIONS OF SALE (T&Cs)

ART. 1 - IDENTIFICATION OF THE SELLER

These General Terms and Conditions of Sale govern the purchase of products via the website flashenergyshoes.it (hereinafter the "Website"). The Website is owned and operated by Giani Laura, with registered office at Via Fratelli Bronzetti, 14 - 50137 Florence (FI) - Italy, VAT No. IT07508100489 (hereinafter the "Seller"). The commercial brand used is Energy Flash Shoes.

ART. 2 - SCOPE AND CONCLUSION OF THE CONTRACT

2.1. By placing an order, the Customer confirms that they have read, understood, and accepted these T&Cs in their entirety. 2.2. The contract is considered finalized when the Seller sends an Order Confirmation to the email address provided by the Customer. The Seller reserves the right to cancel orders due to stock shortages or suspected fraud, providing a full refund.

ART. 3 - PRODUCT INFORMATION AND VISUAL DISCLAIMER

3.1. The Seller selects and markets footwear from international third-party suppliers. Images and colors of products are for illustrative purposes only. The Seller cannot guarantee that the Customer’s monitor display accurately reflects the real product. 3.2. Minor aesthetic discrepancies or material variations that do not affect the functionality of the footwear are considered production tolerances and do not constitute a lack of conformity.

ART. 4 - PRICES, CUSTOMS DUTIES, AND IMPORT TAXES

4.1. All prices are expressed in Euro (€) and include VAT where applicable. 4.2. Import Responsibility: As products may be shipped from international warehouses outside the European Union, the Customer acts as the "Importer of Record". Any customs duties, import taxes, or local fees applied by the destination country's authorities are the sole responsibility of the Customer. Refusal to pay these charges does not entitle the Customer to a refund.

ART. 5 - SHIPPING AND PASSING OF RISK

5.1. Delivery Times: Estimated delivery times (7-15 business days) are indicative and not binding. The Seller is not liable for delays caused by customs procedures, international logistics disruptions, or force majeure. 5.2. Liability: The Seller is not responsible for non-delivery due to incorrect or incomplete addresses provided by the Customer or failure to collect the package from the carrier's pick-up point. 5.3. The risk of loss or damage to the goods passes to the Customer once they (or a designated third party) take physical possession of the product.

ART. 6 - RIGHT OF WITHDRAWAL AND RETURNS

6.1. In accordance with EU regulations, Customers have a legal right to withdraw within 14 days. Energy Flash Shoes extends this period to 30 calendar days from the date of receipt. 6.2. Condition of Goods: Returns are only accepted if the shoes are in their original condition, unworn (except for indoor fitting on a clean surface), and in their original packaging. The shoe box must not be used as the outer shipping container. 6.3. Return Costs: Shipping costs for returning the goods are the sole responsibility of the Customer. We strongly recommend using a tracked shipping service.

ART. 7 - LEGAL WARRANTY

7.1. The Seller is liable for any lack of conformity existing at the time of delivery for a period of 2 years (24 months) as per EU consumer law. 7.2. The warranty does not cover damage resulting from improper use, improper washing, or normal wear and tear of the materials (e.g., sole erosion).

ART. 8 - LIMITATION OF LIABILITY

8.1. The Seller shall not be liable for any direct or indirect damages caused by website malfunctions or delivery delays by third-party carriers. 8.2. In any event, the Seller's total liability shall not exceed the total price paid by the Customer for the specific product in question.

ART. 9 - APPLICABLE LAW AND JURISDICTION

9.1. These T&Cs are governed by Italian law. 9.2. Any dispute relating to the interpretation or execution of this contract shall be subject to the exclusive jurisdiction of the court of the Customer's place of residence or domicile.
